An Angola, Ind., man has been charged with murder in the death of his father Wednesday, March 9th (just west of our Williams / Fulton County coverage areas).
Cody Scott Smith, 25, was charged with one count of murder Thursday before Magistrate Randy Coffey. He pled not guilty was appointed a standy public defender.
Cody Smith will be held without bond at the Steuben County Jail until his pretrial at 11 a.m. May 2 before Superior Court Judge William Fee.
Police were called to the scene after a call to 911 reported a man laying in the road bleeding from his head, Prosecutor Jeremy Musser said. When the police arrived they found Rusty Smith, 51, laying face down with gunshot wound exiting the back of his head.
“The suspect had fled the scene,” Musser said.
Around 3 p.m. a call came in to 911 about an individual with a gun in the Nevada Mills Road area. Cody Smith was found with his girlfriend and a child, the prosecutor said.
“Law enforcement responded and located the subject,” Musser said. “They took him into custody without incident.”
Musser would not comment on any motive, saying the investigation is ongoing, with officers still executing search warrants. The police located a handgun they believe is the murder weapon in the vicinity of where he was arrested.
There may have been two female eyewitnesses to the crime, Musser said.
Musser credited local, county and state law enforcement for working together to apprehend the suspect.
