The Monday, May 2 meeting of the Wauseon City Council was called to order at 5:00 p.m. by Mayor Kathy Huner. Following the Pledge of Allegiance and moment of silence, roll was called by the Clerk of Council. Present was Council President Stiriz, Councilors Kost, Schamp, Chamberlin, S. Stiriz and Frey to constitute a quorum for the transaction of City business.
Council President Stiriz moved and seconded by Councilor Chamberlin to approve the previous meetings’ minutes. The motion was passed unanimously.
The meeting also marked the annual joint meeting of the Wauseon City Council and the Clinton Township trustees to elect a board member to the Wauseon Union Cemetery. Shane Chamberlin was up for reappointment for the term January 2, 2017 to January 1, 2020.
Roll was taken by the Clerk of Council. Present were Council Members Jeff Stiriz, Kost, Schamp, Chamberlin, Scott Stiriz, and Frey; Clinton Township Trustees present: Hite, Richer, and Neuenschwander.
Councilor Schamp moved and seconded by Clinton Township Trustee Richer to reappoint Shane Chamberlin to the Wauseon Union Cemetery Board for the term January 2, 2017 to January 1, 2020. The motion passed with 8 yeas and o abstention (Scott Stiriz).
Committee reports heard by council included:
Holiday Committee– April 19, 2016
Councilor Frey reported that the Holiday Committee has been working on fundraising activities for the 4th of July Fireworks. There was a fundraiser at Sullivans Restaurant on April 13, 2016 and the next one is at Los Mariachis on May 12, 2016. Councilor Frey stated also council would like to recognize the art classes at Wauseon High School and Mike Colon, teacher, for decorating the firemen’s boots that will collect money for donations that will be placed at various businesses.

Tom Hall – Code Administrator
Mr. Hall reported that there is a motion to schedule a public hearing regarding a recommendation from the Planning Commission for a zoning change pertaining to transfer of some property to adjoining property owners to Sara’s Garden.
Dennis Richardson – Director of Public Service
Mr. Richardson reported the legislation for the advertisement for the construction of a new pool is under first reading. The contractor is now working on the road bed on the Linfoot St. project. The clarifier painting project at the Water Treatment Plant is essentially completed. Last week he went to Cleveland along with two employees from the Water Reclamation Plant to look at a sludge press operation that is mobile on a trailer. This is something the city may consider doing as a pilot study at the Water Reclamation Plant to see how it performs and as a viable alternative. He has had to interface with Peterman Associates primarily with the ADA ramps for the downtown.
Councilor Frey asked about the purpose of the sludge press operation. Mr. Richardson said the purpose is to drain the water out of it and convey it to a truck and take it to the landfill. It is harder to find land for application of our sludge and less cropland available in general.
Jamie L. Giguere – Director of Finance
Mrs. Giguere reported that she provided council with the month end YTD reports. Income tax revenues are up over 8% from a year ago. She is also working with our GAAP accountant and preparing worksheets for him to finish our financial statements.
Thomas A. McWatters III – Director of Law
Mr. McWatters reported that there is a motion for council regarding the Intergovernmental Agreement for Access to Data Tower between Fulton County and City of Wauseon. This agreement essentially allows the city the opportunity to put some apparatus on their tower and if in the process we interfere with their service, we will take them down.
In legislative matters, Mayor Huner read out loud by title the following legislation presented for first reading Resolution 2016-6 – Authorizing the Mayor to Advertise for Bids for Construction of the New Pool; Authorizing the Mayor to Accept the Lowest and Best Bid; Authorizing the Mayor to Enter into a Contract with the Lowest and Best Bidder. Councilor Schamp moved and seconded by Councilor Kost to place Resolution 2016-6 on first reading and that the first reading be passed. The motion was unanimously approved.
Mayor Huner also read out loud by title the following legislation presented for third reading Chapter 523 – Smoking in Workplace and Public Places; Ordinance 2016-5 – Amending Section 523.03 (m) of the Codified Ordinances of the City of Wauseon (add definition of electronic cigarettes and other electronic products or devises that produce a vapor). Councilor S. Stiriz moved and seconded by Councilor Frey to place Ordinance 2016-5 on third reading and that the third reading be passed. The motion passed unanimously and the ordinance will be effect on June 1, 2016.
In new business:
Schedule Public Hearing
Councilor Schamp moved and seconded by Councilor Chamberlin to schedule a public hearing for Monday, May 16, 2016 at 5:00 p.m. to rezone the 8’ strip of property that sits behind lots 13, 14, 15, 16 and 17 in Palmer’s Addition from B4 Community Mixed Use District to R3 Single Family Residential District. The motion passed unanimously.
Intergovernmental Agreement for Access to Data Tower between Fulton County and City of Wauseon
Council President Stiriz moved and seconded by Councilor S. Stiriz to authorize the Mayor to sign the Intergovernmental Agreement for Access to Data Tower between Fulton County and the City of Wauseon. The motion passed unanimously.
Tree Commission Resignation – Tom Savage
Councilor Kost moved and seconded by Councilor Schamp to accept the resignation of Tom Savage from the Tree Commission for the term ending 12/31/16. The motion passed unanimously.
Tree Commission Appointment – Larry Frey
Councilor Schamp moved and seconded by Councilor Kost to appoint Larry Frey to the Tree Commission for the unexpired term of Tom Savage ending 12/31/16. The motion passed unanimously.
Councilor Frey moved and seconded by Councilor Chamberlin to approve and pay the bills as presented. Mayor Huner then asked for a motion to enter into Executive Session regarding Personnel/Discipline. Councilor Kost moved and seconded by Council President Stiriz to enter into Executive Session at 5:20 p.m. Council exited out of Executive Session at 5:44 p.m. with no further action being taken.
The next meeting of the Wauseon City Council will be held at 5:00 PM on May 16 in council chambers.
